THE CONSTITUTION ON SCOUT'S HONOR:
THE FIRST AMENDMENT AND STATE TREATMENT OF THE BOY SCOUTS
 

Since 1911, boys across the United States have joined the Boy Scouts by taking an Oath which states, in part, "On my honor I will do my best to do my duty to God and country" and "to be physically fit, mentally awake and morally straight." The State of Connecticut has recently excluded the Scouts from its annual employee fundraising campaign benefiting 900 charities, by concluding that the Scout Oath discriminates against homosexuals. In California, the Scouts are fighting other exclusions by local governments on the grounds that the Oath discriminates against atheists as well as homosexuals. Similar cases have been brought in other states across the country. Our panel of experts will discuss these and other cases, and the statutory and First Amendment issues they involve, including the alleged civil rights violations, and the extent to which these are trumped by freedom of association and freedom of speech.
